1. Who am I?

I am Rob Picot of 152A High Street, Aylesbury, Bucks. HP20 1RE. I organise and manage skippered charters on my yacht Delphinus and I am the skipper. When you book a charter with me, I will do my very best to make your time aboard as enjoyable as possible. You can see from this website the standards which I maintain, and more details of what you can expect whilst chartering with me. I reserve the right to change the details from time to time if I consider it to be necessary, but I will always try to equal or improve the offer where possible.

2. Booking

Prices and details of availability can be found on this website.

Booking generally will be via an online facility. You may check with me that your chosen dates are available and an email confirming your booking will be sent to you as soon as your deposit is received. The amount of your deposit is shown in the Prices and Availability section of this website where you will also find the BACS details of my bank account.

You must advise me of any medical conditions or disabilities which might affect your ability to enjoy your time on the yacht before your booking is confirmed.

The balance of your booking fee will be payable not later than 60 days before the date of your arrival to join the yacht. Once again, receipt of your funds will be acknowledged by email.

You will see from this website that I can usually be flexible within two days either side of the scheduled charter dates to accommodate your flights. You must advise me as soon as possible after booking your flights, when you would like to be welcomed on board.

Please note that you are responsible for your own flights and travel arrangements to Dubrovnik, but complementary transport will be included from the airport to Delphinus. 

3. My obligations

I will do my very best to fulfil the expectations you have of all matters set out on this website.

Before we sail and during your charter, I will try to answer any questions you may have about your charter. Sailing, whilst enjoyable, is a hazardous adventure activity and a calm days’ sailing can turn into a challenging experience very quickly. I take all reasonable precautions to ensure your safety, but injury and medical emergencies can arise. I am a qualified First Aider and the yacht will have a Category C offshore medical first aid kit, Lift Raft, automatic Life Jackets and a full range of safety equipment aboard.

I hold full vessel insurance and a copy will be provided on request. 

4. Your responsibilities

Whether you are an experienced sailor or a complete novice you must understand that sailing has its dangers which are sometimes completely unexpected.

You must always follow my instructions on matters of safety. You will be given a full safety briefing on board the yacht as soon as practicable after your arrival. However, everyone must accept responsibility for following instructions and for their individual safety. Children on board will be the responsibility of the adults in their party. If you are in any doubt about anything, particularly about safety on board, it is your responsibility to ask questions and be satisfied that you understand the rules and procedures completely.

Please respect my instructions as skipper on any matter that I believe to be of importance.

I advise you to take out insurance to cover medical issues and any other loss that you might incur.

Smoking or vaping is not allowed on or inside the yacht.

If any member of your party behaves in a way that I consider to be totally unreasonable, is a danger to themselves or other members of the party or behaves in an offensive manner including taking any illegal substances on board, I will be entitled to put the offending person or members ashore at the nearest port or harbour from which public transport can be taken back to Dubrovnik. I may terminate the charter forthwith at my absolute discretion.

All members of your party must advise the me at least 7 days before you join the yacht, of any food allergies or intolerances. Since you will be on a catered yacht, I cannot be responsible if you don’t advise me of any issues.

Accidents on board can happen and items can be damaged or lost overboard. You must report any loss or damage to me as soon as you are aware of it.

Loss or damage which is deliberately or negligently caused by you may be charged for.

You will be responsible for complying with any Coronavirus Regulations which may apply to you whether those of your own country or those of Croatia applicable at the time.

5. Allergens

YOU MUST ADVISE ME WHEN BOOKING of any food allergies (ie something which might give rise to an anaphylactic reaction) or intolerances. The food and drinks I serve on board are mainly if not exclusively locally sourced and may contain such ingredients as dairy products, eggs, wheat, soya beans, mushrooms, nuts and shellfish to name a few common items which can cause reactions.

Whilst I will take all reasonable precautions to prevent cross contamination of foodstuffs while preparing meals, I will not accept any liability for any that does occur.


     If you have any allergies or intolerances and have any fear of possible cross contamination or concerns about the ingredients of any foods that I offer, you must make your own arrangements to provide your own alternatives.

6. Changes or Cancellation

In the unfortunate event that I need to cancel your charter because of my indisposition or of some problem with the yacht I will let you know immediately the circumstances arise.

You will be offered an alternative date if that is possible but if a suitable date for all of us can’t be found, then you will receive a full refund of the moneys you have paid.

If this happens, I will not be responsible for any consequential costs such as flights, hotel accommodation or other expenses.

If I become indisposed during the charter, I will do my best to ensure that you continue to enjoy your stay but if circumstances require, I will make a reasonable refund to you for the time lost.

If you wish to change your booking, I will use all reasonable endeavours to find another time for your charter within 12 months of the previous date. You will be responsible for any additional charges that might apply to bookings at the revised time.

If you wish to cancel your booking altogether the following charges will apply:
- More than 60 days before the charter begins – a full refund of all monies paid less any bank charges;
- Less than 60 days – there will be no automatic refund, but I will use all reasonable endeavours to re-sell the period of your charter. If successful, I will
refund all monies paid by you less any shortfall in the new price obtained and £500 towards my marketing and administration costs;
- If you fail to arrive as planned, there will be no refund. 

7. Limitation of my liabilities

Other than for death or injury caused by my negligence I cannot accept responsibility for any loss or injury.

I will not be liable if am unable to provide all the experiences advertised on the website for reasons which are beyond my control. An example of this is if I decide that the weather conditions make it unwise to sail, in which case my decision is final.

My liability to you will be limited to the price of the charter for which you have paid.

8. Data Protection

I will use your data only for necessary processing of matters in connection with your charter. I will not give any data to any person or organization not so connected without your prior consent.

I will hold any private personal information provided to me in connection with your booking which is not publicly available for a period of three years after the completion of your charter unless otherwise agreed between us.

9. Law and jurisdiction

In the event of any dispute between us, the laws of England and Wales will apply and we agree to submit to the Courts of that Jurisdiction.

I will use your data only for necessary processing of matters in connection with your charter. I will not give any data to any person or organisation not so connected without your prior consent.

Disclaimer

I confirm that I have read these Terms and Conditions of Delphinus Yachting and have made all other guests in the party aware of them. As a precondition of making the booking I confirm that all of us accept the Term and Conditions.
